1. Introduction
1.1. The use of the website and/or the "ETA VISA ISRAEL LTD" service (from now on: "the website" and/or "the service") is subject to the terms of use detailed below (from now on: "the terms of use"), including the provisions in the privacy policy and subject to all applicable laws. You (from now on: "the user") agree to these terms when using the website.
1.2. The use of the website is permitted only for users who are legally competent or for corporations. The use is solely for legal purposes and is subject to the terms of use detailed below, including the provisions in the privacy policy, and subject to all applicable laws, which constitute the legal basis for any interaction or action taken within this framework. The use of the website, including browsing and/or visiting the website and/or placing an order through the website, constitutes your explicit consent as the user to these terms.
1.3. The purpose of the terms of use is to clarify the relationship between the operator of the website, ETA VISA ISRAEL LTD, Company No. 516833225 (from now on: "the operator"), and any person and/or entity accessing the website and/or using the operator's services. Browsing and using the website constitute your consent as the user to these terms and your commitment to act by them. If you do not agree to all the terms of use, do not use the website. Therefore, before performing any action on the website, you must carefully read the terms of use, including the privacy policy. If you do not agree to all the terms of use, please refrain from using the website.
1.4. In the terms of use and all texts appearing on the website, singular terms shall also mean plural terms and vice versa, and masculine terms shall also mean feminine terms and vice versa, all according to the context. The terms of use are drafted in the masculine form for convenience only and are not intended to offend or discriminate in any way.
1.5. These terms of use constitute the entire agreement between the parties and supersede any prior agreement, proposal, or representation made in writing or orally regarding its subject matter. In any case of contradiction and/or inconsistency of any kind between the website's content and the provisions of the terms of use, the provisions of the terms of use shall prevail.
1.6. It is clarified that the operator may, at any time, change and/or discontinue the website's operation in whole or in part at its sole discretion and without any need for prior notice, without the user having any claims against the operator for this.
1.7. The service is active 24/7 and can be used at any time. However, the website may be unavailable due to malfunctions beyond the operator's control that may occur at any time, during various maintenance works, or for other reasons, and the user will not have any claims against the operator for this.
1.8. If you have any questions, clarifications, comments, or issues related to the service, you can email the operator at contact@etaisrael.com. It is clarified that the contact details mentioned above and the operator's availability may change at the operator's sole discretion and without prior notice, and the user will not have any claims against the operator for this.
1.9. The operator's service is limited solely to technical assistance in submitting and preparing an application for Israel to obtain the ETA-IL entry approval. For the avoidance of doubt, the operator does not handle the approval process of the ETA-IL (which is dependent on the approving authority, including the Government of Israel) and cannot guarantee that a visa will indeed be approved and/or that the terms of the requested visa will be to the user's satisfaction. The user will not have any claims if a visa is not obtained at the end of the process and/or if a visa is obtained under conditions not to the user's satisfaction. It is also clarified that no refund will be given if a user does not obtain a visa and/or if the conditions of the visa obtained are not to the user's satisfaction.
1.10. It is emphasized that the operator is an independent business company that is not affiliated with and is not responsible for the entities that will review the visa application.
2. Definitions
"The Content" means the website, the contents appearing on the website and in the user account, the online pages included therein, the classification, arrangement, and presentation of the information, and any other form of representation included in mailings and text messages.
"The Service" means the website, the user account, including related instructions and guidelines, related products and other services, hosting services, personal support services if and when provided, and any changes and/or amendments to those above as may be completed by the operator from time to time at its sole discretion.
"The Account" means the account opened in the service framework in your name on the website or any use of the operator's service without opening an account.
"Site Errors" means any interruption in the website's availability caused by reasons beyond the operator's direct control.
"You" and "Users" mean, among others, individuals and entities authorized by the operator to use the service, as well as your employees, consultants, contractors, agents, and/or third parties with whom you conduct business.
"Your Data" means all data and/or electronic information submitted by you and/or collected by the operator on the website during the use of the website.
"The Visa" means an entry visa for which applications are submitted with the operator's and the website's assistance (including an entry visa to the State of Israel).
3. Payments; Cancellation Policy; Supplies
3.1. The use of the service involves payment in the amount and under the terms determined by the operator from time to time, as detailed on the website. The operator reserves the right to update the payment amount or increase or decrease it at any time at its sole discretion and without prior notice. The user will not be entitled to a refund and/or discount and/or any benefit if there is a change in the service price and will not have any claims and/or demands from the operator regarding this matter.
3.2. The website allows payment by credit card or any other means, as the operator occasionally determines.
3.3. Subject to the provisions of any law, including the provisions of the Consumer Protection Law, 1981, due to the nature and essence of the service, no refunds will be given after the purchase of the service.
3.4. The response to the ETA-IL application request will be emailed within 3 business days, except in exceptional cases (in exceptional cases, the response to the request may take up to 14 business days).
4. User Responsibility for Service Use and Disclaimer of Liability
4.1. The operator's service is limited solely to technical assistance submitting and preparing a visa application. For the avoidance of doubt, the operator does not handle the visa approval process (which depends on the approving authority, including the Government of Israel) and cannot guarantee that a visa will indeed be approved and/or that the terms of the requested visa will be to the user's satisfaction. The user will not have any claims if a visa is not obtained at the end of the process and/or if a visa is obtained under conditions not to the user's satisfaction. It is also clarified that no refund will be given if a user does not obtain a visa and/or if the conditions of the visa obtained are not to the user's satisfaction.
4.2. The terms of the visa offered to the user are determined by third parties, including the competent authorities in the Government of Israel, and the operator cannot be responsible for these terms.
4.3. Although the operator makes the most effort to assist the user in obtaining the visa, it is clarified that the operator only guarantees that the visa application will indeed be approved. Therefore, the user will not have any claims against the operator. In any case, the final decision regarding the approval and/or rejection of the visa application is not made by the operator but by third parties who are not under the operator's control and are not affiliated with the operator.
4.4. The user commits that all the information provided is accurate, reliable, and up-to-date, and it is the user's sole responsibility to ensure this before using the service. To avoid doubt, the operator will not be responsible for any false declaration and/or incorrect entry of the visa application details.
4.5. The operator will not be liable for any damage or harm, direct or indirect, caused to the user due to using and relying on the content and services offered on the website, including a claim that a visa was not obtained. The user will not have any claims due to reliance on the information published on the website and the fact that, as a result, they did not use other services such as, but not limited to, submitting a visa application independently. The user will not have any claims regarding the information published on the website, and the operator will not be liable to the user regarding the information published on the website and/or information obtained by a third party through the website.
4.6. The operator does not guarantee that the links on the website and/or mailings and/or text messages will be functional and lead to an active website. A link to a particular site on the website does not imply that the site's content is reliable and/or complete and/or up-to-date, and the operator will not bear any responsibility in this regard. Without derogating from the above, the operator is not responsible for any direct or indirect damage caused to the user and/or their property as a result of using and/or relying on the information and content appearing on the sites reached through or via links on the website.
4.7. The services on the website may be interrupted and/or accompanied by errors and/or not provided as usual without interruptions. The operator does not guarantee that the website will be immune from unauthorized access to the operator's computers, damages, malfunctions, hardware, software, or communication line failures at the operator or its suppliers, or be affected for any other reason. The operator will not bear any responsibility for any damage, direct or indirect, caused to the user and/or any third party or their property due to this, including but not limited to the loss of information uploaded by the user.
4.8. The information and services available within the service provided on the website may include inaccuracies or typographical errors. The operator does not guarantee or declare that the service will be uninterrupted or error-free, errors will be corrected, or that the service or the server that provides the service will be free of viruses or other harmful components. The operator does not guarantee and/or declare that the use or results of using the service or the materials provided through the service will be accurate, correct, reliable, or dependable.
4.9. The user explicitly agrees that the operator will not be responsible in any way for unauthorized access to or changes made to the user's information or messages, whether sent or received by them.
4.10. The operator is not responsible for the content of advertisements or commercial offers from third parties that may appear on the website. Any claim, demand, or lawsuit from a user regarding offers, products, or services as mentioned, their receipt or outcomes, should be directed directly to the third party from whom the offer was received or the service was purchased, and the user will have no claim or demand against the operator and/or anyone on its behalf regarding this.
4.11. During the pilot period, which expires on 01/08/2024, the basis of the application is voluntary and there is no obligation to submit this application.
5. Intellectual Property
5.1. All intellectual property rights, including moral rights, economic rights, copyrights, trademarks, trade names, patents, designs, trade secrets, and any other rights related to the website, including but not limited to the content, design, editing, and presentation of the information appearing on the website, are exclusively reserved for the operator.
5.2. Without derogating from the above, the website, the online pages included therein, the classification, arrangement, and presentation of the information, advertisements, and mailings sent by the operator, including the classification, arrangement, and presentation of the information and advertisements appearing therein, and any other form of representation included on the website and in such mailings, are the exclusive property of the operator.
5.3. It is prohibited to copy and/or reproduce and/or duplicate and/or create derivative works and/or alter and/or adapt the content of the website, in whole or in part, for distribution, publication, display, performance, transmission, broadcasting, making available to the public, sale, and/or any other action without obtaining prior written approval from the operator.
5.4. The content is to be used solely for the purposes for which it is intended: for the user's private and personal needs, as opposed to commercial purposes. It is clarified that the user may use the content solely for uploading content to their account and issuing commands regarding its use at times determined by them. Any other use of the content is strictly prohibited, including for the promotion, marketing, and advertising of businesses and commercial entities.
5.5. The user undertakes not to publicly disclose the content and/or any part thereof except under the conditions specified on the website. The user also undertakes not to publicly disclose any product and/or output of the information, whether it is printed or provided as a file on magnetic media or in any other form, and not to copy and/or reproduce and/or duplicate and/or create derivative works and/or alter and/or adapt the content of the website, in whole or in part, for distribution, publication, display, performance, transmission, broadcasting, making available to the public, sale, and/or any other action without obtaining prior written approval from the operator.
5.6. The ownership and intellectual property rights in third-party content, including images and videos that appear on the website, are the property of the content owners and may be subject to the terms of use of third parties who have lawfully granted the operator a license for such content (from now on: "Third-Party Agreements"). The operator does not claim ownership rights and does not assume any responsibility for any content of this nature displayed on the website. The user acknowledges that the terms of such Third-Party Agreements will bind them concerning the use of the service, including any future changes to the Third-Party Agreements.
5.7. The operator respects the rights of third parties and takes the necessary steps to avoid infringing on any third-party rights. If the rights of a third party have been inadvertently violated, you can report an infringement of intellectual property rights by emailing contact@etaisrael.com.
6. User Obligations
In the event of malicious and/or negligent and/or any other harmful use of the service provided on the website by the user and/or anyone on their behalf, and/or due to a breach of these terms of use, the operator shall be entitled to take action against the user, including but not limited to blocking them from using the service without any prior notice and at its discretion. The user will not have any claims against the operator for this. Additionally, the user shall indemnify the operator, its employees, directors, shareholders, or anyone on their behalf for any damage, loss, loss of profit, payment, or expense incurred by them, including attorney fees and legal expenses.
7. Privacy and User Information
7.1. The operator respects the privacy of users on the website. Information regarding the privacy policy can be found in the privacy policy published on the website.
7.2. Upon registering on the website, the user may be asked to choose a username and password and provide various contact details. These details are required to enable the user to access restricted website areas. It is the user's sole responsibility to keep these details confidential and to update them from time to time so that only the user can use them. The operator and/or anyone on its behalf will not be responsible for any activity in the user's account and/or personal area by anyone who used the user's login details.
8. Direct mail
8.1. The operator may offer each user of its services, upon registration, the opportunity to join and receive direct mail to inform them about publications, updates, personal benefits, and other notifications that may update users about the operator's activities and various services, including via email and text messages (from now on: "Direct Mail").
8.2. During registration, the user may be given the option to consent to receive direct mail from the operator by checking a designated box during the registration process to the operator's services to their email inbox and/or mobile phone, which will constitute their consent to receive advertisements. It is clarified that the user will have the option at any stage to request the operator to cease sending direct mail by contacting the operator and/or through the unsubscribe options that will appear in the direct mail sent to the user.
8.3. To avoid doubt, it is clarified that the provisions regarding direct mail are subject to the law, including the Communications (Telecommunications and Broadcasts) Law, 1982.
9. Security
9.1. The operator's website is secured using advanced security measures to ensure proper and safe site use and maintain users' privacy and the information uploaded to their user accounts. Each website user undertakes not to engage in any activity that may disrupt the website's operation, including but not limited to information theft and hacking of the website's security mechanisms. The operator will act against any such activity in any legal manner, including blocking the user from accessing the service and taking legal action against the user if they act as mentioned. However, it is clarified that the operator cannot guarantee absolute protection against such actions. Therefore, the operator will not bear any responsibility regarding attacks that may lead to security breaches and data leakage from the operator's computers, among other things, as a result of such attacks.
9.2. In the event of malicious, negligent, or harmful use of the website by the user and/or anyone on their behalf, the operator is entitled to block the user's access to the service. The user will be required to indemnify the operator, its employees, directors, shareholders, and/or anyone on their behalf for any damage, loss, loss of profit, payment, or expense incurred by them, including attorney fees and legal expenses.
10. Term and Termination
10.1. This agreement will become effective on the day the user uses the website and will continue until the user ceases to use the service.
10.2. The operator may terminate this agreement at any time in the following cases: (1) the user has violated any provision of this agreement (or has acted in a manner that indicates that they intend to do so or are unable to comply with the provisions of the agreement); (2) the operator is required to do so by law (for example, when the provision of the service is or will become illegal); (3) the provision of the service is no longer economically viable. In such cases, the operator will provide the user with reasonable notice in advance of the termination of the agreement, as far as possible.
10.3. The operator may change these terms occasionally at its sole discretion. The users are responsible for staying informed of such changes by periodically reviewing these terms of use. Use of the service at any time constitutes acceptance of the updated and amended terms as they were at that time.
10.4. The operator reserves the right to modify or discontinue the service or any part thereof on the website without prior notice. In the event of discontinuation, the operator will not be liable to the user or any third party for any damage or loss.
10.5. The provisions regarding intellectual property and the disclaimer of liability will remain in effect after the agreement is terminated.
11. General, Jurisdiction, and Notices
11.1. These terms of use, including the privacy policy, constitute the entire agreement between the parties and supersede any previous agreement, proposal, or representation made in writing or orally regarding its subject matter. Any change, amendment, or waiver of a provision in this agreement will not be valid unless made in writing and signed or electronically approved by the party against whom the change, amendment, or waiver is claimed.
11.2. The information and service are offered to the user on an "AS-IS" basis. The user agrees and acknowledges that the operator, its employees, directors, shareholders, or anyone on their behalf will not be liable for any direct or indirect damage caused to the user and/or any third party related to the user due to the user's use of the information and/or the user's reliance on the information presented on the website.
11.3. These terms of use will be governed exclusively by the laws of the State of Israel. The competent courts in the Tel Aviv district will be the exclusive jurisdiction for any matter regarding these terms of use and website use.
11.4. Any letter sent to the operator will be considered as received upon sending by email, provided the sender has a delivery confirmation.
